OSHA doesnt require footwear for all employees, see source. Customers arent covered by OSHA at all and there are NO Health Department laws requiring footwear for customers either.

In the right kind of environment I wouldnt think twice. Beach cafe, bohemian restaurant, vegetarian hangouts!!! If however I went to say The Ivy for supper and was served by a barefooter then I might think Ooh! Also, if the feet were filthy and stinky then I would be unimpressed.
